My mrs works in HR and sees stuff like this fairly often

If it's all been verbal, then it's difficult to conclude what is and is not banter.

If things are in email, then without context it's going to very likely look like bullying whether it is or it isn't.

My missus had a case of a woman who flirted with a guy loads, who then changed her mind and called it sexual harassment - it's very very difficult to judge where the line is.
