What is more damning is the witness account in the story

which seems to imply that it was Ruddy who was drunk and being rude to people in the run up to the incident and called the bloke over to him although the text is suitably ambiguous so the witness could have been talking about the other bloke. I'd say that's a fairly crucial element of the story.
