yes, they definitely are

thing is, the moment you try and think what they *should* be, you realise it's really hard. Any way of writing them leads to some problems.

Best I can think of is to go back to a lot more judgement on the part of the ref - does he think the player *mean* to handle it, or deliberately did something that made it likely they would. But it would drive some people wild when they disagreed with the ref, and claimed there isn't 'consistency' between games and refs.
