Nope, 48.13 overrules it

If it’s safe enough to restart (and 48.3 dictates that you can’t have an SC if there is no need for it) then you do so under 48.13. Unsafe manoeuvres are not then permitted (para 3)

48.12 only applies where it is deemed ‘safe to do so…’

There is no express right in 48.12 for a lapped car to be permitted to unlap itself.

So once it’s safe to restart you have to, you can’t use 48.12 to drag it out just to let Hamilton win.

(is broadly what Red Bull lawyers might be arguing)
