I suspect there would be a big argument around the need to stick to pre agreed decision making processes and not bypassing it through lawyers.
A big legal case like this would be so destructive to the integrity of the EPL (and EFL which has a similar structure) that it wont be allowed to happen. Which gives a degree of leverage.
I'm loosely involved in similar issues in another sport and as far as I can tell* lawyers aren't even in the room on the big decisions. It's all exec level stuff.
(*or maybe I'm just not a top lawyer *sad face*)
