Looking at your post the other day and the prem rules it seems to me that

it wouldn't necessarily be the FA Council who have to first decide to abandon relegation.

The premier league clubs could between them resolve not to have any relegation this season subject to the approval of the FA as "special shareholder" couldn't they?

I wonder if the Premier League may do that and put the ball in the EFL's court. If they resolve not to have relegation and allow two up into an expanded premier league for one season only then they could presumably leave it up to the EFL to grapple with how they decide which two (and to be sued by the likes of Fulham).
