As long as its not a glaring tactical ploy to buy more time, the EU will have a hard job proving otherwise (and let's face it, they are not taking us to the ECJ over it). All sides will be well aware that if it was served again in the near future, the UK will have zero goodwill in any fresh withdrawal negotiations.
