a virtual border will work for those that abide by the law

the former paramilitaries, that are still operating as organised criminal gangs, with an existing line in smuggling, will not be abiding by the laws

being in the customs union takes away much of their reasons to smuggle - mostly the same taxes and tariffs are levied on both sides - that'll soon be changing
