Having watched again, tend to agree. However...

My immediate reaction was no pen and it was right in front of me.

I probably wouldn't have given it in my reffing days based on real-time view but with benefit of replay the arm was on the throat area as if to push him away.

Law says "push or attempts to push" so could have been given.
