Yes but its not a simple as that really. I think you have to disregard the outcome

as difficult as that may be. I think this is also an area of the law where there have been developments in recent years so I don;t really know what the legal definition of gross negligence is. The courts used to basically take the view that there was little or no difference but in some areas of the law a definition has been introduced. for example in some finance regulations its:

"acting without caring whether an infringement occurs"

I don't know if that's been carried over into this type of civil inquest situation. What i think can definitely be said is that the police made a very big f**k up but I would think you can probably be grossly negligent and have nobody die or just negligent and have 96 people die as a consequence.
