I'm a prosecutor involved in this stuff a lot.
In the example you give, we have to prove you "deliberately and intentionally and with knowledge knew he was ‘making’ such an image". So if you random nut job just sent it without warning, you're ok. If there's evidence to suggest you knew what you were clicking on, you're not.
