Can I ask a stupid question?

I am by no means a law expert.

If the governemnt were to clearly win this case, would this mean the the prime minister could prorogue parliament in a manner he sees fit and with a clear indication that such a move would be completely lawful?

Could this be used as a means to prorogue parliament through the second half of October to force hard brexit?

If I recall correctly, the previous situation where Gina Miller forced the government to put the withdrawal agreement to a meaningful vote rather backfired when it was rejected three times increasing the risk of no deal.

Could this massively backfire as well?
